An Bord Pleanala has this week refused an appeal by owners/developers Kelly Drain Services against refusal by WCC to allow retention of their septic tank cleaning business currently operating out of a premises on Drummin Lane.

The main issues with this were the interference with the Mass Path, which has been surrounded by a high palisade fence, and also their ongoing use of an unauthorised entrance which they created onto Farrankelly Road. This has no proper sightlines or slip lane, and trucks use it to exit directly onto the dual carriageway, thereby creating a traffic hazard .

Delgany Community Council was one of the 19 community groups and individuals who made submissions objecting to the original planning proposal, which would have legitimised the effective closure of this section of the Mass Path to pedestrians.

An enforcement notice which WCC issued last year, requested them to remove the palisade and gates which they had erected around the Mass Path. This enforcement notice has not been enforced, so far.
